Therefore, we recommend regarding these Terms and Conditions of Sale and Privacy Policy carefully before using the Site.
1.4 We reserve the right to make changes to the Site and these Terms and Conditions of Sale and Privacy Policy at any time without notifying its users. Your continued use of this Site following the posting of changes or modifications to these Terms and Conditions of Sale and Privacy Policy will constitute your acceptance of such changes or modifications. You may not use our trademarks or service marks in connection with any product or service in any way that is likely to cause confusion. You may not use our trademarks or service marks in any manner that disparages or discredits us. You may not use any of our trademarks or service marks in meta tags without prior explicit consent.

2.3 You may not through any means reproduce, imitate, distribute, display, sell, lease, or manufacture any products, art, designs, images or any other material that is identical or similar to the products and items displayed and sold on the Site (“Products”).

3Registration

 

In order to take advantage of the features and services of the Site, you can either utilize the Site on a “guest check-out” basis or create an Account and register your details with us. It is your ongoing responsibility to make sure that any personal and payment details you provide to us are valid, accurate and complete. Please keep your account details and password confidential and secure. Our customer service agents will never ask you for your password. We are committed to complying with our Privacy Policy but are not responsible for any loss suffered through misuse of those details. 4.1.1   We collect information supplied by you via the Site, other websites operated by us, or any of our Site customer service channels including without limitation on the phone, via email, during your personal shopping visits, or via our Live Chat feature (where available). We also collect information when you visit our Site, other websites operated by us, or from third parties authorized to share your information with us. We may collect some of this information even if you are not a registered user or do not place an Order. This information may include:

(a) Contact and personal details such as name, delivery address, phone number, email address, billing and payment information, date of birth, gift recipient details, gender, nationality and personal shopping preferences;

(b) Site statistical information such as your location, the URL you use to access the Site, browser or device type/unique fingerprint, your computer’s IP address and domain type, which pages you visited, search terms you entered, Products you clicked on;

(c) Transactional information such as Orders you placed, Products you purchased, date and time of Order as well as Orders you decided not to complete or Products you placed in your basket and discarded, preferences you have indicated to us, requested personalization of Products;

4.1.2      Please note that your full payment card details are captured only for the purposes of processing your transaction and are not stored, sold or rented by us. Your full payment card details are not available to our staff. All card transactions are managed by trusted, certified and legally authorized partners who are responsible for ensuring that your payment details remain secure during the payment process.

4.5 Protecting Your Data

4.5.1  Information you provide to us via our Site is stored on secure servers. Any payment transactions carried out through our Site will be encrypted using secure socket layer technology. It is your responsibility to keep any Site passwords or login codes issued to or chosen by you, confidential.

4.5.2  We have implemented various steps to safeguard the integrity of our information technology infrastructure, including by implementing authentication, monitoring, auditing, and encryption technology. Security measures have been integrated into the design, implementation, and day-to-day operations of the Site as part of our continuing commitment to the security of electronic content and the electronic transmission of information. 6Users’ communications

You consent to receive communications from us electronically, such as e-mails, texts, mobile push notices, or notices and messages on the Site, and you can retain copies of these communications for your records. We may use text messaging to communicate with you about pending orders, inquiries or other transaction-related interactions that may be initiated by you. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

7Order Acceptance

 

7.1 Order Acceptance: Our acceptance of your order will take place when we notify you of our acceptance in writing. If we are unable to accept your order, we will inform you of this in writing or through a call and will not charge you for the Product.

7.2 Payment:

7.2.1 By placing an order, you authorise us or our third-party payment processer to process your credit/debit card details for the amount of your order. We accept payment by,

(a) credit card/ acceptable debit card.

7.2.2 In order to authorise credit/debit card payments, we may be required to create an account for you with our third-party payment processors, including accepting their standard terms and conditions and submitting your details to them on your behalf. You hereby authorise us to do so and we shall not be liable to you for any damage or loss you may incur as a result.

7.2.3 We may remove or add cards or other payment methods that we accept at any time without prior notice to you.

 
7.3 Cancelling Order: 

7.3.1 Once an Order is placed, you will not have the right to cancel the Order unless it is inline with Section 7.3.2. In all events and in all cases, except for section 7.3.2. (c ), a cancellation of an Order will not result in a refund, even when such cancellation happens before shipment.

7.3.2 We may cancel your Order(s) if:

(a) you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the Products; or

(b) you do not, within a reasonable time, allow us to deliver the Products to you or collect them from us; or

(c) Order(s) not being capable of being fulfilled due to Product(s) not being available.

7.4 Typographical Errors

In the event a Product is listed at an incorrect price due to typographical error or error in pricing information, we reserve the right to refuse or cancel any Orders placed for a Product listed at the incorrect price. We reserve the right to refuse or cancel any such Orders whether or not the Order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your Order is cancelled, we will issue a credit to your credit card account in the amount of the incorrect price within a reasonable time period.

8Return and shipment policies

9Warranties, Representations and Undertakings

 

9.1  You warrant, represent and undertake that:

9.1.1 You shall fully comply and will at all times continue to fully comply with all applicable laws, statutes and regulations, including, without limitation, all privacy laws and content regulation;

9.1.2  You have full power and authority to enter into these Terms and Conditions Terms of Sale and Privacy Policy, and make payment in accordance with these Terms and Conditions of Sale and Privacy Policy; and

9.1.3  If you purchase a product on behalf of a business entity, you represent that you are authorised to act on behalf of such business and bind the business to these Terms and Conditions of Sale and Privacy Policy.

10Disclaimer of Warranty

 

10.1  The use of the Site is at your own risk. The Site is offered to you on an as is and as available basis without any representations or warranties of any kind, express or implied, as to the operation of the Site or the information, content, materials, or products included on the Site. To the full extent permissible by applicable law, we disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose, non-infringement, title, quiet enjoyment, data accuracy and system integration. The Site may include inaccuracies, mistakes or typographical errors. Neither us, nor our affiliates, third party information providers, nor other content partners make any guarantee regarding the accuracy, correctness, timeliness, sequence, reliability, or completeness of any information or content provided on the Site.

10.2  Additionally, there are no warranties as to the results obtained from the use of the information. Any material downloaded or otherwise obtained through the use of the information. Any material downloaded or otherwise obtained through the use of the Site is downloaded at the user’s own risk. The user will be solely responsible for, and assumes the entire cost of, all necessary servicing, repair, or correction in the event of any damage or loss due to content, downloads or any other material or information the user obtains from the Site.

13Choice of law, place of jurisdiction

 

These Terms and Conditions of Sale and Privacy Policy are governed by the federal laws of the UAE, and all disputes arising here under are subject to the exclusive jurisdiction of the courts of Dubai, UAE.

14.1 These Terms and Conditions of Sale and Privacy Policy and any other legal provisions published by us on the Site, constitute the sole agreement between you and us regarding your use of the Site.

Capitalized terms used herein but not otherwise defined shall have the same meaning as are respectively assigned to them in the Terms.
      1. Return issues
          1.1 In case you got the wrong size:
               1.1.1. You would email support on regarding requests for a return of the Product. If the return is requested within 7 calendar days of receiving the Product, we will accept the return request.
               1.1.2 Our customer support team will get in touch with the Customer to arrange the replacement.
               1.1.3 You will only be allowed one replacement as we will be bearing the cost of this.
          1.2 In case the Customer gets Product with a factory defect:
               1.2.1 You would email support regarding a request for a return of the Product as it has a factory defect, with proof of the defect. You will provide us with a clear description of the fault as well as an image of the Product to our customer support team at merchsupport@anghami.com
               1.2.2 We will then take one of the following decisions:
                  1.2.2.1 Contact the carrier to arrange pickup while arranging a replacement of the Product for you;
                  1.2.2.2 Request you to keep or dispose of the Product while arranging a replacement of the Product for you;
We in either case will cover the cost of the Product and shipping if a return request is received within seven (7) days of receiving the Product.
          1.3 In case the quality of the Product is below a reasonable range of expectations:
                  1.3.1 You would email support regarding a request for a return of the Product with a valid, stated reason within seven (7) calendar days of receiving the Product. You will provide us with a clear description of the reason for your request as well as an image of the Product to our customer support team at merchsupport@anghami.com.
                  1.3.2 We will then take one of the following decisions based on your request:
                      1.3.2.1 You want a replacement: we will contact the carrier to arrange pickup while arranging a replacement of the Product for you;
                      1.3.2.2 You have requested multiple returns: we will contact the carrier to arrange pickup while arranging a refund of the Product for you.

           1.4 For all the foregoing cases, all returned Products must be in new and unused condition, with all original tags and labels attached.
           1.5 In some cases, we may request you to ship us the Product, place the Product securely in its original packaging, mail your return to the following address:

Return shipping charges will be paid or reimbursed by us.

 

  2. REFUNDS

After receiving your return and inspecting the condition of your Product, we will process your return or exchange. Please allow at least three (3) days from the receipt of your Product to process your return or exchange. We will notify you by email when your refund has been processed.
          – Refunds will be made back to the payment method initially used by the Customer;
          – Please allow up to seven (7) working days for the refund transfer to be completed;
          – Please note that Products once washed will not be exchanged or refunded.

Capitalized terms used herein but not otherwise defined shall have the same meaning as are respectively assigned to them in the Terms.

 

      1.Delivery of Order

            1.1 Delivery Costs: The costs of delivery will be as displayed to you on our Site. The delivery cost will differ from one country to another and will be displayed on the checkout page once you place your Orders and add your delivery location.
Please note, we may be subject to various rules and restrictions in relation to some international deliveries and you may be subject to additional taxes and duties over which we have no control. If such cases apply, you are responsible for complying with the laws applicable to the country where you live and will be responsible for any such additional costs or taxes.

 

            1.2 Delivery Date: The estimated delivery date will be displayed to you on our Site on the checkout page once you place your Order and add your delivery location. All times and dates given for delivery of the Products are given in good faith but are estimates only.
If delivery is delayed for any reason, we will let you know as soon as possible and will advise you of a revised estimated date for delivery.

 

      2. Shipping Issues

            2.1 In case of wrong Customer information and/or Customer not responding:
– We will review shipping information to validate the delivery address or phone number before dispatching the Product. If shipping information is deemed incorrect or incomplete, we will be required to confirm the delivery address with you. If you fail to respond or provide the needed information, we will keep the purchased Product in the factory until we have the needed information to ensure the successful delivery of the Products. If we do not hear back from you or remain in possession of incorrect or incomplete information for a period of five (5) calendar days, the Order will be canceled without any refund.

 

– If the address is validated by you but the carrier has any issues with the address (such as lack of further detail, house no., apartment no. etc), the carrier will call you to and rectify the address. One final delivery will be attempted. If failed, the Product will be stored at the carrier office for three (3) calendar days for pickup. If the Product has not been picked up, the Product will be returned to our warehouse. The Customer will have to pay the delivery fees once again in the event that the Customer asks to have the Product delivered a second time after being returned to our warehouse.

 

– If the phone number is incorrect, we will email you asking for the right number before dispatching the Order. If the number has been validated from your end but the carrier is unable to reach you, the carrier will contact us to recommend next steps (such as emailing you again or recommending you to pick up from the carrier office). If failed, the Product will be stored at the carrier office for three (3) calendar days for pickup. If the Product has not been picked up, the Product will be returned to our warehouse. The Customer will have to pay the delivery fees once again in the event that the Customer asks to have the Product delivered a second time after being returned to our warehouse.
